Terms and Conditions


These terms and conditions apply to all purchases, so please read them carefully.

1. Acknowledgement
Providing you give us a working email address all website orders will be acknowledged and we will inform you if there will be any significant delay before they are despatched.

2. Availability
All orders are subject to availability of products. If the products you order are not available we will notify you immediately and give you the choice of either cancelling or waiting for delivery by an agreed date.

3. Prices
While we try to ensure that all prices on our website are accurate mistakes can sometimes occur. If we discover an error in the price of products you have ordered we will contact you as soon as possible and give you the option of either reconfirming your order at the correct price or cancelling it.

4. Returns Policy
Items may be returned to us within 7 days of receipt provided they are in original condition. Your payment will then be returned in full (minus any shipping charges)

5. Secure payment online
When you place your order online your details are fully encrypted and your payment is handled by WorldPay. This prevents the possibility of unauthorised access or disclosure.

6. Privacy
Information you give us will in no circumstances be released to third parties (see our separate GDPR compliant Privacy Policy).

7. Cards accepted
We accept most major credit and debit cards.

8. Alternative methods of payment
You do not have to pay for your goods through the website. You can place your order by telephone or you can pay by cheque, by money transfer, or we can send you a PayPal invoice.

9. Fulfilment
Please note that your credit/debit card will be debited before despatch. If we are then unable to fulfil your order for any reason we will refund your payment immediately.

10. Delivery
As the majority of our products are made to order, delivery times are individually listed in the product description. You will be notified when the product has been dispatched. Orders are sent via Royal Mail or a selected courier based on size and should arrive within 3 working days of dispatch. However please allow up to a maximum of 28 days.

11. Import Duties and Taxes
You are responsible for the disclosure and payment of any import duties or taxes which apply in the country to which the products are delivered.

12. Limited Warranty
All RowScape products are guaranteed against failure for 24months from the date of purchase. If a product proves to be faulty within this period you may return it to us for repair or exchange, whichever we decide is appropriate.

13. Product Changes
RowScape have a policy of continuous product
improvement so we reserve the right to change product specifications without notice.

14. Validity
If any of these Terms and Conditions are held to be unenforceable it shall not affect the enforceability of the rest of these Terms and Conditions.

15. No Variation or Representation
Nothing said by RowScape personnel shall amount to a variation of these Terms and Conditions or a representation about the nature or quality of our products except where this is confirmed in writing by a director of the company.

16. Governing Law and Jurisdiction
English law governs these terms and conditions and you submit to the exclusive jurisdiction of the English courts.

 

Privacy Policy

This privacy policy sets out how RowScape uses and protects any information that you give us. This policy is effective from the 25th of May 2018.

 

Introduction

In the simplest terms, GDPR (General Data Protection Regulation) is a new privacy law introduced in the UK on 25th May 2018. It protects users from unauthorised data collection by requiring explicit consent. If data is being collected and stored, the individual providing the information needs to be aware of it and give permission before any action is taken. Along with providing permission to collect data, the GDPR also requires that users can request access to their data and have it removed if requested.

 

GDPR, the basics

Personal Data

We hold your Personal Data under secure conditions using the following software which is GDPR compliant.

• Sage CRM Database

• Sage Accounts

• iContact

Consent

We are using the grounds of Legitimate Interest to maintain contact with our existing pre-May 25th, 2018 CRM database. All new clients will be asked to positively opt-in after this date.

Breach Notification

As required, we will inform contacts of a data breach within a 72-hour window of becoming aware of the occurrence of a data breach.

Right to Access

RowScape will provide confirmation as to whether personal data concerning you is being processed by us, where the data is being stored and for what purpose. Furthermore, we will provide a copy of the personal data, usually free of charge, in writing.

Right to be Forgotten

The right to be forgotten entitles you to obtain from the controller the erasure of any personal data without undue delay and to stop any further distribution of the data.

Data Portability

GDPR introduces data portability; the right for a data subject to receive the personal data concerning them, which has previously been provided in a ‘commonly used and machine-readable format’, and to have the right to transmit that data to another company or organisation. It’s about ‘transferring’ data between suppliers. e.g. allowing a customer to switch bank or insurance provider easily, without having to set everything up from scratch. Although we are not involved in this type of information sharing, we will only pass your information on for delivery purposes.

 

Marketing Platforms & Activities

Our marketing platforms and activities are compliant with GDPR going forward.

At RowScape, we use iContact for almost all our client email marketing communications.

Our iContact signup forms are incorporated into our website; they collect the email address, IP address and timestamp. They are set to require ‘double opt in’ – which emails the user to confirm they would indeed like to join the mailing list. When data is collected via an iContact sign up form, the relevant permission data is then stored within our iContact list and is compliant with the new record keeping regulations. At the point of information collection, we will make it clear to users how and where we will be storing your information and how we will be using it.

The option to unsubscribe is also present inside each email communication sent via the iContact platform and is managed accordingly directly in our iContact list.
